Matthew M. Hart - Attorney at Law

Matthew Hart graduated from John F. Kennedy University School of Law in Pleasant Hill, California. He has been focusing on Estate Planning for his entire legal career. He has attended Continuing Legal Education classes in "Drafting effective Wills and Trusts", "Advanced Estate Planning Techniques", and "Fundamental Probate Procedures and Practice". He is a California State Bar certified speaker on "Avoiding Financial Elder Abuse".

Prior to becoming an attorney, Matthew Hart attended Eugene Bible College and spent 20 years in the information technology sector as a Senior Server Engineer and Manager of Intel Server Architecture. He worked for such companies as Barclays Global Investors, Compucom, and Bechtel.

He has a wife of 20 years and a teenage daughter.  As a result, this life experience allows him to uniquely understand client issues related to Estate Planning.

Estate Planning A common practice at some legal firms, is to use paralegals at different points in meeting with clients and the preparation of legal documents. At our firm, you will meet with an attorney and all documents will be prepared by an attorney using the most effective legal methods available.  In the Estate Planning context we create Wills, Trusts, Durable Powers of Attorney, and Advanced Health Care Directives.

 

Additionally, our wills are distinguished by providing testimonial sections whereby the Christian client is able to impart their spiritual beliefs and values to their remaining loved ones upon their passing.  This testimonial section provides a powerful opportunity for the deceased to speak to their loved ones one last time and serves as a final declaration of their living faith and hope for eternity.

 

Trust Administration Upon the passing of a person who created a trust, there is always trust administration that must occur.  In the case of a married couple when the first spouse passes there is administration to be done as well as when the second spouse passes.  We work with our clients to ensure that all laws are complied with during the trust administration.  Failure to comply with these laws can have serious tax consequences as well as probate consequences.  Additionally, the trustee is liable for these mistakes.  It is imperative that a trustee hire an attorney to guide them through the trust administration process.  Our firm is well versed in this area and will guide the trustee through the process of trust administration while helping to minimize the time it takes for the administration.

 

Probate For those estates that need to pass through probate our firm will work with the executor/administrator to navigate the probate process.  Utilizing an attorney can minimize the time required for the probate process and reduce the likelihood of a lengthy probate process.  Additionally, there are complex forms and specific timelines that have to be met in order to preserve all of your rights.  Finally, the executor/administrator is liable for their actions and our firm will keep you informed of all of the laws and help you to avoid the mistakes that most lay people make.

 

Conservatorships If you have a loved one that is not able to care for themselves or their finances a conservatorship of the person or estate may be required.  Our firm will work with you to file the papers with the court and then help you to manage the estate so that your loved one is not taken advantage of.
